Ng Ken Yong (Ken) read law at the University of Hertfordshire and was admitted as an Advocate and Solicitor of the High Court of Malaya in 2017. During the tenure of his legal practice, he is accustomed to high stakes and high-pressure litigation. He regularly appears as both lead and co-counsel in all tiers of the Malaysian Courts for the conduct of trials, hearings and appeals.

Ken is a Senior Legal Associate in Messrs Low & Partners and focuses his practice on fraud, insolvency, construction, corporate and commercial dispute resolution matters. He has developed a passion for complex tortious and economic disputes and believes that justice is providing the best value and outcome for his clients. He enjoys the excitement of developing matured arguments to assist in the development of the law in a particular area. His ‘hands on’ approach ensures that practical solutions are achieved regardless of the complexity of the dispute.

Notable cases/experiences:

Fraud/Insolvency

  1. Successfully represented the liquidator of a clothing manufacturing and supply company in the High Court and Court of Appeal in recovering preferential payments of around RM6.5 million received by the company’s former directors and their associates.
  2. Successfully represented 8 subsidiaries in a group of metal manufacturing and supply companies in the High Court and Court of Appeal and Federal Court from a claim of approximately RM24 million involving allegations of fraudulent misrepresentation and fraudulent trading.
  3. Successfully a director of a pharmaceutical company in the High Court in defending a claim for breach of duties by the company of approximately RM2 million.
  4. Successfully represented a company secretary in defending a claim filed by a former director of a multinational company who had disgorged an excess of RM5 million from the said company.
  5. Represented the liquidator of a clothing manufacturing and supply company and its creditors in the High Court and Court of Appeal and Federal Court to hold the former directors and officers of the company liable for their involvement in a wrongful conspiracy which depleted the company’s assets and properties valued in the excess of RM45 million.
  6. Represented a public listed company listed in Bursa Malaysia in defending a claim by the Securities Commission of Malaysia against its directors and shareholders.
  7. Represented multiple creditors of a wound-up company in a legal action to remove the existing liquidators.
  8. Advised and assisted liquidators of a well-known company in the water filtration industry in the investigations into the alleged fraudulent affairs of a company.
  9. Advised and assisted the liquidator of once a leading stone supplier in the investigations into the affairs of a company.

Construction

  1. Successfully represented a liquidator in the High Court in an action for specific performance concerning a 5-storey shopping complex and an office tower in Kemaman, Terengganu.
  2. Represented a reputable company in the construction industry in pursuing a claim of RM79.5 million against a government linked company.
  3. Represented various contractors and subcontractors in pursuing and defending Adjudication proceedings.

Corporate/Commercial

  1. Successfully represented a landowner in the High Court in a commercial dispute concerning 40 acres of durian orchard valued at approximately RM4 million.
  2. Successfully represented a purchaser of a luxury German automobile in making a claim against the dealer for the supply of a defective automobile.
  3. Represented a shareholder of a construction company in a dispute over shares held on trust valued at approximately RM22 million.
  4. Represented directors and shareholders of a company in various legal actions to regain control of the company.
  5. Represented a major financial institution in the High Court in an assessment of damages involving a claim of approximately RM20 million arising from an injunction that remained in place for 14 years.
