Drug Offences
Drug offences are among the most serious criminal offences in Malaysia, carrying heavy penalties including long-term imprisonment, whipping, or even the death penalty in cases involving trafficking.
At Low & Partners, we understand the gravity of such accusations and provide strategic, discreet, and determined defence at every stage. Whether you are facing charges of possession, consumption, trafficking, or manufacturing of drugs, we will fight to protect your rights. We scrutinise the validity of search and arrest procedures, challenge the admissibility of evidence, and advise you on the best course of action, whether mounting a full defence or negotiating for a lesser charge or sentence.
The common charges in Malaysia include:
- Section 15(1) Dangerous Drugs Act 1952, which shall be liable to a fine not exceeding RM5,000 OR to imprisonment for a term not exceeding 2 years.
- Section 39A (1) Dangerous Drugs Act 1952, which shall be punished with imprisonment for a term not less than 2 years but not exceed 5 years AND whipping of not less than 3 strokes but not more than 9 strokes.
- Section 39A (2) Dangerous Drugs Act 1952, which shall be punished with life imprisonment OR for a term not less than 5 years AND whipping of not less than 10 strokes.
- Section 39B Dangerous Drugs Act 1952, which shall be punished with death penalty.
