Criminal Breach of Trust
Criminal Breach of Trust (CBT) can be under criminal and civil legal frameworks:
Criminal Aspect:
CBT is a criminal offence where a person entrusted with property or dominion over property dishonestly misappropriates or converts for their own use.
At Low & Partners, we defend and advise clients facing investigation or prosecution for CBT, including employees or agents accused of misappropriating company funds.
The common charge in Malaysia is Section 405 of the Penal Code, which may be in result of imprisonment for a term not exceeding 10 years AND whipping AND fine.
Civil Aspect:
In addition to criminal prosecution, victims may pursue civil claims for recovery of misappropriated assets including claims against employees or agents and breach of fiduciary duties.
