Notable Experience

Corporate, Commercial & Shareholders’ Disputes

  • Acted for three defendants in a High Court case where serious allegations of corporate wrongdoing and conspiracy were made against them. Successfully applied to have the plaintiff’s entire claim struck out by the Court on the basis that it was an abuse of the legal process.
  • Acted for defendants in a High Court case involving the enforcement of a lien over shares, where a shareholder owed money to the company, and the company sought to recover that debt through the shareholder's shares under its Articles of Association. Successfully opposed an urgent court injunction sought by the plaintiff to prevent the company from doing so.
  • Successfully represented the plaintiff in a High Court breach of contract claim, obtaining judgment for damages of RM350,000 together with interest and costs.

Appellate matters

  • Successfully acted for the respondent in a Court of Appeal matter involving a dispute over a vehicle that the opposing party had wrongfully refused to return (a claim for the return of goods). The High Court had granted judgment in our client's favour; on appeal by the opposing party, the Court of Appeal upheld that decision and dismissed the appeal.
  • Successfully acted for the respondent in a Court of Appeal matter involving an application to assess a person’s mental health and capacity under the Mental Health Act 2001. The High Court had struck out the case brought by the opposing party and the Court of Appeal upheld that High Court’s decision in the respondent’s favour.
