Section 39B. Trafficking in dangerous drugs

(1) No person shall, on his own behalf or on behalf of any other person, whether or not such other person is in Malaysia-

(a) traffic in a dangerous drug;

(b) offer to traffic in a dangerous drug; or

(c) do or offer to do an act preparatory to or for the purpose of trafficking in a dangerous drug.

(2) Any person who contravenes any of the provisions of subsection (1) shall be guilty of an offence against this Act and shall be punished on conviction with death or imprisonment for life and shall, if he is not sentenced to death, be punished with whipping of not less than twelve strokes.

(3) A prosecution under this section shall not be instituted except by or with the consent of the Public Prosecutor:

Provided that a person may be arrested, or a warrant for his arrest may be issued and executed, and any such person may be remanded in custody notwithstanding that the consent of the Public Prosecutor to the institution of a prosecution for the offence has not been obtained, but the case shall not be further prosecuted until the consent has been obtained.

(4) When a person is brought before a Court under this section before the Public Prosecutor has consented to the prosecution the charge shall be explained to him but he shall not be called upon to plead, and the provisions of the law for the time being in force relating to criminal procedure shall be modified accordingly.

The Dangerous Drugs Act 1952 [Act 234], which is referred to as the “principal Act” in this Act, is amended in section 39B—

(a) by substituting for subsection (2) the following subsection:

“(2) Any person who contravenes any of the provisions of subsection (1) shall be guilty of an offence against this Act and shall be punished on conviction with death or imprisonment for life and shall, if he is not sentenced to death, be punished with whipping of not less than fifteen strokes.”; and

(b) by inserting after subsection (2) the following subsections:

“(2A) In exercising the power conferred by subsection (2), the Court in imposing the sentence of imprisonment for life and whipping of not less than fifteen strokes, may have regard only to the following circumstances:

(a) there was no evidence of buying and selling of a dangerous drug at the time when the person convicted was arrested;

(b) there was no involvement of agent provocateur; or

(c) the involvement of the person convicted is restricted to transporting, carrying, sending or delivering a dangerous drug; and

(d) that the person convicted has assisted an enforcement agency in disrupting drug trafficking activities within or outside Malaysia.

(2B) For the purposes of subsection (2A), “enforcement agency” means—

(a) the Royal Malaysia Police;

(b) the National Anti-Drugs Agency;

(c) the Royal Malaysian Customs Department;

(d) the Malaysian Maritime Enforcement Agency; or

(e) any other enforcement agency as may be determined by the Minister.”.

The Dangerous Drugs Act 1952, which is referred to as the "principal Act" in this Part, is amended in section 39B-

(a) in subsection (2), by substituting for the words "be punished with whipping of not less than fifteen strokes" the words "be punished with whipping of not less than twelve strokes"; and

(b) by deleting subsections (2A) and (2B).

Seksyen 39B. Pengedaran dadah berbahaya

(1) Tiada sesiapa boleh, bagi pihak dirinya sendiri atau bagi pihak mana-mana orang lain, sama ada orang lain itu berada di Malaysia atau tidak—

(a) mengedar dadah berbahaya;

(b) menawarkan untuk mengedar dadah berbahaya; atau

(c) melakukan atau menawarkan untuk melakukan apa-apa perbuatan sebagai persediaan kepada atau bagi maksud pengedaran dadah berbahaya.

(2) Mana-mana orang yang melanggar mana-mana peruntukan subseksyen (1) adalah melakukan suatu kesalahan di bawah Akta ini dan apabila disabitkan, hendaklah dihukum dengan hukuman mati atau penjara seumur hidup dan jika tidak dijatuhkan hukuman mati, hendaklah dikenakan hukuman sebatan tidak kurang daripada dua belas kali sebatan.

(3) Suatu pendakwaan di bawah seksyen ini tidak boleh dimulakan kecuali oleh atau dengan keizinan Pendakwa Raya:

Dengan syarat bahawa seseorang boleh ditangkap, atau waran tangkap terhadapnya boleh dikeluarkan dan dilaksanakan, dan orang tersebut boleh ditahan dalam jagaan walaupun keizinan Pendakwa Raya untuk memulakan pendakwaan bagi kesalahan itu belum diperoleh, tetapi kes itu tidak boleh diteruskan tanpa keizinan tersebut.

(4) Apabila seseorang dibawa ke Mahkamah di bawah seksyen ini sebelum Pendakwa Raya memberikan keizinan untuk pendakwaan, pertuduhan hendaklah dijelaskan kepadanya tetapi dia tidak akan dipanggil untuk membuat pengakuan, dan peruntukan undang-undang prosedur jenayah yang berkuat kuasa pada masa itu hendaklah dipinda sewajarnya.

Pindaan-Pindaan Tambahan
Sebelum dipinda oleh Akta 846, subseksyen (2) berbunyi seperti berikut:

“…dan jika tidak dijatuhkan hukuman mati, hendaklah dihukum dengan penjara seumur hidup dan sebatan tidak kurang daripada lima belas kali.”

Subseksyen (2A) dan (2B) — (Telah dipadam melalui Akta 846) — sebelum ini membenarkan mahkamah mengambil kira faktor-faktor seperti berikut semasa menjatuhkan hukuman penjara seumur hidup dan sebatan:

(a) tiada bukti urus niaga jual beli dadah ketika tangkapan dibuat;

(b) tiada penglibatan ejen provokator;

(c) penglibatan tertuduh hanya terhad kepada pengangkutan, penghantaran atau membawa dadah;

(d) tertuduh membantu agensi penguat kuasa dalam menggagalkan aktiviti pengedaran dadah di dalam atau di luar Malaysia.

Agensi penguat kuasa dalam konteks ini merujuk kepada:

  • Polis Diraja Malaysia (PDRM)
  • Agensi Antidadah Kebangsaan (AADK)
  • Jabatan Kastam Diraja Malaysia
  • Agensi Penguatkuasaan Maritim Malaysia (APMM)
  • Mana-mana agensi lain seperti yang ditentukan oleh Menteri
